Sri Suresh Singh, learned counsel for the petitioners contends that due to inadvertence the pedigree showing the relative position of the parties could not be produced in the impleadment application. Necessary pleadings were also not taken.
Learned counsel for the petitioners prays that the petitioners may be permitted to approach the appellate court afresh after taking relevant pleadings and bringing the pedigree of the parties record. It is prayed that the appellate authority may decide the matter within a stipulated period of time.
Interest of justice will be served by issuing following directions:
(1) The petitioner shall file an affidavit taking the aforesaid pleadings and also an application for interim relief before the appellate court/Additional Commissioner Administration, Gorakhpur Division, Gorakhpur.
(2) In case the said application is filed by the petitioner the appellate court/Additional Commissioner Administration, Gorakhpur Division, Gorakhpur shall decide the application for interim relief within a period of one month from the date of receipt of said application after hearing all necessary parties including Maa Devi Tarakulha Dham Charitable Trust.
(3) The appellate court/Additional Commissioner Administration, Gorakhpur Division, Gorakhpur shall decide the appeal after hearing all necessary parties including Maa Devi Tarakulha Dham Charitable Trust within a period of four months thereafter.
The writ petition is disposed of.
