Heard learned counsel for the petitioner, learned counsel for the Gaon Sabha and the learned Standing Counsel.
The plot involved in the instant case is plot no. 1465ka. While the petitioner was claiming the plot no. 1465ka to be his own land, the Gaon Sabha staked its claim.
To get the record corrected the petitioner has already moved an application on 12.7.2021.
Grievance of the petitioner is that while no order was being passed on the application of the petitioner, the possession of the petitioner was being disturbed.
Under such circumstances, without going into the merits of the case, it is being directed that the application dated 12.7.2021 filed under Section 38 of the U.P. Revenue Code, 2006, be given a regular number and thereafter the same may be decided after hearing the petitioner and the gaon sabha within a period of two months from the date of presentation of a certified copy of this order.
For a period of two months or till the decision of the application dated 12.7.2021 whichever is earlier status quo as of today with regard to plot no. 1465ka shall be maintained.
With these observations, the writ petition is disposed of.
