Heard Shri Pankaj Gupta, Advocate holding brief of Shri Tushar Gupta, learned counsel for the petitioner and Shri H.P. Srivastava, Advocate appearing on behalf of the State respondents through video conferencing.
Shri Rakesh Chaudhary, Advocate has accepted notice on behalf of the respondent No.1.
The present petition has been filed with a prayer to command the opposite party No.3 for deciding the petitioner's objection raised on 12.04.2021 as regards the caste certificate issued to opposite party No.5.
The objection with regard to caste certificate has already been dealt with by the competent authority by passing an order. At this stage, when the election has already been notified and scheduled on 19.04.2021, all issues having a bearing upon the election cannot be entertained in exercise of writ jurisdiction leaving it open to the petitioner to avail the remedy for instituting the election petition.
The present writ petition being not maintainable is accordingly rejected.
