1. Heard Sri Ashok Kumar Singh, learned counsel for the petitioner; Sri Gopi Krishna Sood, Advocate, holding brief of Sri Azad Rai, learned counsel appearing for the Gaon Sabha and learned Standing Counsel for the State- respondents.
2. On oral prayer, learned counsel for the petitioner is permitted to implead Tehsildar, Tehsil-Maintha, District- Kanpur Dehat, as respondent no.7, during the course of the day.
3. Petitioner appears to be aggrieved by some encroachment made on public road. However, at present, the application has not been made before Tehsildar, Tehsil-Maintha, District-Kanpur Dehat, who is the competent authority.
4. Without entering into the merits of the case, present writ petition is disposed of with a direction that in case, the petitioner files a proper application in the form and manner prescribed before respondent no.7-Tehsildar, Tehsil-Maintha, District-Kanpur Dehat, within a period of two weeks from today alongwith a copy of this order, it is expected that the said authority will act in accordance with law and pass appropriate orders on such application, as expeditiously as possible, preferably within a period of three months from the date of such application being filed before it.
