Criminal Misc. Parole Application No.4 of 2018 Heard Sri Rajeev Sawhney, learned counsel for the appellant and Sri Amit Sinha, learned AGA for the State.
On behalf of appellant-Jai Gupta @ Dharmendra Gupta, this application has been filed for short-term bail on the ground of marriage of his daughter to be solemnized on 09.02.2019.
Counsel for the appellant submits that for performing Kanyadan, presence of appellant-Jai Gupta @ Dharmendra Gupta is necessary and, therefore, he be granted short-term bail for doing the needful.
State counsel, after verification, submits that the appellant's daughter is getting married on 09.02.2019.
Considering the facts and circumstances of the case, it is directed that appellant-Jai Gupta @ Dharmendra Gupta be released on short-term bail on 04.02.2019 in connection with Sessions Trial No.837 of 2005: State Vs. Santosh Pathak and Others (Crime No.74 of 2005) under Section 302 of IPC, Police Station-Luxa, District Varanasi on furnishing two sureties and personal bond of Rs.50,000/- to the satisfaction of the Court concerned. He shall be released from the Jail in the morning of 04.02.2019 and he would positively surrender before the Court concerned on 14.02.2019.
It is made clear that the appellant will not, in any manner, harass or threaten the witnesses of the case during this period.
The short term bail application stands disposed of.
