Heard learned counsel for the petitioners and Sri Pradeep Kumar Singh, learned counsel appearing on behalf of respondents.
By the instant petition, petitioners are assailing the order dated 18.08.2018 passed by the third respondent, Regional Director, Employees State Insurance Corporation, Kanpur, and consequential order dated 25.07.2019 and notice dated 21.08.2019 passed by the fourth respondent, Recovery Officer, Employees State Insurance Corporation, Kanpur.
Learned counsel for the respondents, at the outset, submits that the order is appealable under section 45-AA of the Employees State Insurance (ESI) Act, 1948.
This fact is not being disputed by learned counsel for the petitioners.
In view thereof, the writ petition is disposed of as withdrawn with liberty to the petitioners to file statutory appeal alongwith stay application after depositing the statutory amount. In the event, such an appeal along with stay application is filed within 15 days from date, it is expected that the appellate authority shall consider and decide the stay application, in accordance with law, on merit.
