Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The writ petition has been filed by the petitioner challenging the order dated 16.03.2015 passed by the respondent no. 3, the District Magistrate allowing a restoration application, whereby a case has been restored. The consequential revision filed against the order has been rejected.
The proceedings wherefrom this writ petition arises are summary mutation proceedings, which do not determine the title of the parties thereto. However, since the mutation case stands revived the petitioner may contest the same. The mutation proceedings are not liable to be stayed merely on account of pendency of declaratory suit under Section 229-B of the U.P.Z.A. & L.R. Act or for matter on account of pendency of a civil suit between the parties.
The writ petition is dismissed with the observation that the proceedings, which stands revived be decided on their merits as expeditiously as possible, preferably within a period of three months from the date a certified copy of this order is filed before the Court concerned.
