This application is filed by the applicant, claimant with a prayer to disburse the amount of claim award deposited by the Insurance Company on the ground and reasons stated in paragraphs 2, 3 and 4 of this application.
Considering overall aspects, the Tribunal is directed to invest 70% of the deposited decretal amount in any Nationalised Bank in the name of the applicant-claimant initially for a period of three years with periodical renewal till the appeal is finally decided by this Court. Rest of the 30% of the amount is permitted to be withdrawn by the applicant-claimant by account payee cheque after proper verification subject to final result in the appeal. The FDR shall remain with the Nazir of the Court.
With the aforesaid direction, this Civil Application stands disposed of. Rule is made absolute.
