Heard learned counsel for the petitioner and learned Standing counsel.
By means of this writ petition, petitioner challenged the orders dated 27.11.2017 passed by the Deputy Director of Consolidation in Revision No. 1135 of 2017 and order dated 30.3.2017 passed by the Settlement Officer Consolidation, although the order of Consolidation Officer dated 30.7.2016 was also against the petitioner but he has not challenged the same.
The contention of learned counsel for the petitioner is that he has been given the third chak over the land of Plot No. 160/2 which he wants to replace with another land in the said plot there was a pit and therefore, it is not useful for cultivation purpose. The objection of the petitioner was dismissed by the Consolidation Officer vide order dated 30.7.2016 and the said order was affirmed in the appeal vide order dated 30.3.2017. Against both the orders petitioner filed a revision which too was dismissed vide impugned order dated 27.11.2017.
The Deputy Director of Consolidation has specifically recorded a finding to the effect that the petitioner was allotted first chak over his original holding of plot no. 1383 area 0.262, second chak over plot no. 188 area 0.067, third chak over plot no. 160 area 0.069 and the forth chak over plot no. 542 of area 0.074.
The grievance of the petitioner is with regard to the third chak as the same is allotted to the chak holder no. 1248 by giving the land of plot no. 1302. All the orders of the Consolidation Authorities are against the petitioner.
I do not find any illegality or infirmity in the impugned orders, the writ petition devoid of any merits and is accordingly dismissed.
