The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 3.11.2020 passed in Writ Petition No.8394 of 2020 (Jawahar Ganga Parvekshak Vs. State of U.P. and Others). The operative portion of the order is reproduced hereinbelow:-
"It is further directed that if any recovery is made pursuant to order of respondent no. 2 dated 31.12.2019, the same shall be abide by the final order of this Court."
In the present contempt application, the following order was passed on 28.7.2021:-
"Despite service of notice, the Opposite Party No.2 has neither filed counter affidavit nor filed affidavit of compliance.
Issue bailable warrant to Opposite Party No.2 through the Chief Judicial Magistrate concerned.
List this case on 18.08.2021 in the additional cause list.
In order to recall the aforesaid order, the applicant filed recall application.
Today, when the mater was taken up, a prayer has been made by the learned counsel for the applicant to dismiss the present contempt application as not pressed.
In view of the above, order dated 28.7.2021 is recalled and the contempt application is dismissed as not pressed.
