Heard the counsel for the petitioner.
The present writ petition has been filed praying for a writ of mandamus commanding the respondent no. 3, i.e., the District Basic Education Officer, Kaushambi to grant compassionate appointment under the relevant Dying-in-Harness Rules to the petitioner in place of her father late Sri Manrakhan Singh, who was the Headmaster in Purva Madhyamik Viddyalaya Potaniya Ka Pura, Vikas Khand, District Kaushambi and died while still in service.
The petitioner is the married daughter of the deceased employee. It appears from the records that the petitioner was married in 2001.
The petitioner may submit a representation before the District Basic Education Officer, Kaushambi, i.e., respondent no. 3 regarding her claim who shall decide the said representation after inquiring into the dependency of the petitioner over the deceased employee and after considering the fact that the son of the deceased employee is already working as a Teacher in the department of basic education and the representation of the petitioner shall not be discarded merely on the ground that she is the married daughter of the deceased employee.
The representation so filed by the petitioner shall be decided by the District Basic Education Officer, Kaushambi within a period of three months from the date a copy of this order is produced before him.
With the aforesaid direction, the writ petition is disposed of.
