Heard learned counsel for the petitioner and learned AGA for the State.
The instant petition has been filed praying for quashing of notice dated 3.10.2020 under Section 3 of U.P. Control of Gundas Act, 1970. The notice has been issued by District Magistrate, Jhansi, calling upon the petitioner to submit his reply till 13.10.2020 as to why an order under Section 3 be not passed against him.
Indisputably, the petitioner had already shown cause in response to the impugned notice.
Having regard to the said fact, we are not inclined to interfere with the impugned notice at this stage. The writ petition is disposed of with direction to respondent no. 2 to pass final order, taking into consideration the reply given by the petitioner to the show cause notice dated 3.10.2020 expeditiously, preferably within a period of eight weeks from the date of production of a true attested copy of the instant order.
