Heard Sri Samir Khan holding brief of Sri R.K. Verma, learned counsel for the petitioners, Ms. Archana Singh, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioners with a prayer to quash the FIR dated 15.01.2019 registered as case crime No.14 of 2019, under Section 363, 366 I.P.C., P.S. Kanth, District Moradabad.
Learned counsel for the petitioners submits that co-accused Adnan against whom allegations have been levelled in the FIR, has been arrested along with the victim girl. So far as petitioners are concerned, they are family members of Adnan.
Learned A.G.A. opposed the prayer for quashing of the F.I.R.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that petitioners shall not be arrested in the above mentioned case, till submission of the police report under section 173(2) Cr.P.C. but they shall co- operate with the investigation of the case.
With the above direction, this petition is finally disposed of.
