Heard learned counsel for the petitioner and learned AGA for the State as well as perused the record.
The present writ petition has been filed for quashing the order dated 11.12.2019 passed by learned Commissioner, Meerut Division, Meerut in Case No.2205 of 2019 (Compute Case No.201911000002205) as well as order dated 20.09.2019 passed by the learned Additional District Magistrate (Finance & Revenue), District- Baghpat in Case No.381 of 2019 (Compute Case No.201911080000381) (State Vs. Javed @ Julli), under Section 3/4 of the Uttar Pradesh Control of Goondas Act, 1970.
It is contended by learned counsel for the petitioner that Additional District Magistrate, Baghpat, eternment order against the petitioner against which the petitioner has filed an appeal No.02205 of 2019 (Javed @ Julli Vs. State of U.P.) before learned Commissioner, Meerut Division, Meerut, which appeal has been admitted but the stay application has been rejected.
The writ petition is finally disposed of with a direction to learned Commissioner, Meerut Division, Meerut, to consider and decide the petitioner's pending appeal No.02205 of 2019 (Computer Case No.201911000002205) (Javed @ Julli Vs. State of U.P.) as expeditiously in accordance with law preferably within a period of two months from the date of production of a certified copy of this order before him.
For a period of two months from today or till the disposal of the appeal whichever is earlier, effect and operation of the externment order dated 20.09.2019 passed by Additional District Magistrate, Baghpat shall kept in abeyance.
Learned counsel for the petitioner undertakes that petitioner shall file the certified copy of this order along with an appropriate application within 15 days from today before learned concerned court below.
