Heard learned counsel for the parties.
The petitioner is before this Court with the request to command the respondents to pay the pension and other consequential post retiral benefit to the petitioner with compound interest in the light of the judgement dated 25.05.2017 passed in Special Appeal no.290/2017 (Ram Murat Sharma vs. State of U.P. and others) and order passed in Writ Petition no.1638/2018 and Writ Petition no.1640/2018 dated 12.01.2018.
Learned counsel for the petitioner has informed to the Court that in the aforesaid matters, the benefits have been accorded to the similarly situated incumbents and as such, similar relief be accorded to the petitioner also. He has further informed to the Court that for redressal of his grievance, the petitioner has already moved detailed representation on 01.02.2018 before the respondent authorities but the same is still pending.
Learned Standing Counsel and Shri Ved Byas Mishra, Advocate very fairly state that in case any such claim of petitioner for retiral dues is pending consideration, the same shall be decided by the Authorities concerned at the earliest.
In view of the above, without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, on consent, the writ petition is disposed of finally with a direction to the Registrar, Sampurnanad Sanskrit University, Varanasi to look into the grievance of the petitioner and pass appropriate order in the light of the observations made in Special Appeal no.290/2017 (Ram Murat Sharma vs. State of U.P. and others) as well as order passed in Writ Petition no.1638/2018 and Writ Petition no.1640/2018 dated 12.01.2018 within a period of two months from the date of production of certified copy of this order and in case the claim of the petitioner is found to be sustainable, the same shall be referred to the Director of Education (Higher Education), Degree/Pension Section, Allahabad to take final call in the matter within further one month period.
