1. The present application is filed through jail seeking temporary bail for a period of 15 days on the occasion of marriage of nephew (sister's son) named Ashokgiri Goswami, which is scheduled on 17.05.2012.
2. RULE.
Mr.H.K.Patel, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
3. Learned APP made available the jail remarks. The convict is undergoing life imprisonment for an offence under Sections 302, 341, 143, 147, 148 and 114 of the Indian Penal Code in Sessions Case No.195 of 2004 by judgment and order dated 04.06.2007. Last he was released on 28.02.2012 to 12.03.2012 for the purpose of winter crop. No untoward incident is reported. No adverse circumstances are reported, except that he had reported 9 days late in the year 2009 while was on 2nd furlough.
4. For the contents of the application, the application is allowed. The applicant-convict is ordered to be released on temporary bail for a period of 1 (one) week from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
5. The applicant-convict shall surrender to the Jail authorities on expiry of the temporary bail period.
6. Rule is made absolute.
