JUDGMENT / ORDER

Present First Appeal has been filed by the appellant challenging the preliminary decree passed by the Learned Judge, City Civil Court No.5, Amedabad in Civil Suit No.5685 of 1991 by judgment dated 21.12.1992 on the grounds stated in the memo of appeal. Heard learned counsel, Mr.Mehul Shah for the appellant.
Learned counsel, Mr.Shah does not press this Appeal. However, he has stated that the objections or the points, which may be raised, may be considered by the Commissioner for taking accounts.
It goes without saying that as the preliminary decree is passed and record and proceedings are ordered to be transmitted for taking accounts as per Law, he will consider all the points or the objections, which are permissible and raised by the appellant herein. The Commissioner for taking accounts will consider the same expeditiously in accordance with law.
With the above observations, the present First Appeal stands disposed of accordingly.
