1. The present application under Section 5 of the Limitation Act has been preferred by the applicant-original respondent no. 1 in Regular Civil Appeal No. 40/2001 to condone the delay of 13 days in preferring the Civil Revision Application.
2. Though served, nobody appears on behalf of the respondents. Hence, there is no opposition to the present application.
3. Having heard Shri Rushab Shah, learned advocate appearing for Shri S.P. Kotia, learned advocate appearing on behalf of the applicant and considering the averments made in the application and as sufficient cause has been shown, the present application is allowed and the delay caused in preferring the Civil Revision Application is hereby condoned. Rule is made absolute accordingly. No cost.
