Learned counsel for the applicant submitted that applicant is languishing in jail since 26.10.2017 (near about one year half years). It is further submitted that five witnesses have been examined before trial court, they not supported the prosecution case and turned hostile.
Learned A.G.A. prays for and is allowed four weeks' time to file the counter affidavit. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
Call for status report in S.T. No. 38 of 2018 as well as Case Crime No. 226 of 2017, under Section 304 IPC, Police Station Kishanpur, District Fatehpur from the court concerned through learned District Judge, Fatehpur about the present position/status of present case. Report be submitted through learned District Judge on or before 19.7.2019.
It is expected from the court concerned to decide the case expeditiously according to Section 309 Cr.P.C. District Judge, Fatehpur is directed to monitor the case in the monthly meeting of Monitoring Cell.
List in the week commencing 22.7.2019.
S.S.P./S.P., Fatehpur and District Magistrate, Fatehpur are directed to ensure presence of witnesses summoned by the court concerned.
