[1] Heard learned advocate for the appellants as well as party in person Shri Jasvantrai Natvarlal Shah in both the appeals.
[2] The Appeals are admitted on the following substantial questions of law.
[a] Whether the learned Appellate Judge was justified in declaring the order of transfer dated 05.11.2011 of the respondent of Second Appeal No.83/2012 and the appellant of Second Appeal No.84/2012 as mala fide when said Shri Jasvantrai Natvarlal Shah had not challenged the judgment and decree dated 06.05.2009 passed by the learned trial Judge in Regular Civil Suit No.67/2009 whereunder the learned trial Judge had refused to declare the transfer of Shri Jasvantrai Natvarlal Shah to be illegal ?
[b] Whether the appellant of Second Appeal No.84/2012 could have claimed any monetary benefits at Ex.6 in Regular Civil Suit No.67/2009 when the learned Appellate Judge has not declared the transfer of Shri Jasvantrai Natvarlal Shah ?
