Heard counsel for the petitioners and learned standing counsel. By this petition, the petitioners seek a direction in the nature of mandamus commanding the respondent no. 1- Deputy Director of Consolidation, Shahjahanpur to decide Revision No. 7, 8, 9 & 10 filed by respondent no. 2 and Revision No. 73 to 76 filed by the petitioners, pursuant to the order dated 16.5.1979 passed in Writ Petition No. 3658 of 1975, (Divisional Forest Officer Vs. D.D.C. and others), whereby the matter was remanded to the Deputy Director of Consolidation to decide the revisions afresh in the light of observations made in the said judgment, expeditiously within a stipulated period.
Learned standing counsel points out that the aforesaid revisions have already been dismissed vide order dated 20.8.2001 by the Deputy Director of Consolidation as is apparent from the report dated 6.4.2018 submitted by the Settlement Officer Consolidation, Shahjahanpur to the District Magistrate, Shahajahanpur, which has been appended as annexure no. 4 to the writ petition. Therefore, at present no revision is pending.
In the circumstances, no mandamus can be issued for deciding the revisions which have already been decided vide order dated 20.8.2001.
The writ petition is wholly misconceived and is accordingly dismissed. No order as to costs.
