1. Heard Mr. Chinmay Gandhi for Mr. M.B.Gandhi, learned Advocate for the petitioner.

What is challenged in the present petition is rejection of application filed under section 65 of the Bombay Land Revenue Code for Non agriculture permission by the concerned authority i.e. District Collector, Ahmedabad by order dated 5.4.2012. The petitioner intends to file fresh application before the District Collector for conversion of land from agricultural land to non-agricultural land as contemplated under Section 65 of the Bombay Land Revenue Code. If such an application is filed, the District Collector, Ahmedabad, shall scrutinise and consider the same in accordance with law as expeditiously as possible. It is, however, made clear that this Court has not expressed any opinion on merits of the matter. If any such application is filed for the same it may be scrutinised and dealt with by the District Collector on its own merits without influenced by the present order as well as earlier order passed by the District Collector. With this observation, the petition stands disposed of.
