JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pandya, learned APP waives service of rule on behalf of the respondent-State.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to pay the outstanding amount and get the possession of the house which is alloted.
It appears from the jail report that convict was released for the same ground from 19.10.2011 to 17.11.2011 for 30 days. Not only that but thereafter, he has also been released on furlough in the recent past from 20.12.2011 to 2.1.2012.
Under these circumstances, the discretion does not deserve to be exercised, at this stage. Hence, the application is not granted. Disposed of accordingly. Rule discharged.
