The petitioner's vehicle, a Tipper lorry, bearing registration No.KL-13-J-1544 has been ordered to be confiscated for violation of Protection of River Banks and Regulation of Removal of Sand Act, 2001. The value of the vehicle has been fixed at Rs.1,45,000/-. The petitioner has already remitted Rs.43,500/- by Ext.P1. The balance payable by the petitioner for release of the vehicle is Rs.1,01,500/-. The petitioner submits that he may be given instalment facility to pay the balance amount. The learned Government Pleader opposes the prayer of the petitioner that no such facility can be given to the petitioner. The petitioner has a case that he has no further challenge regarding the order passed by the first respondent. Considering the facts and circumstances of the case, I am of the view, the vehicle shall be released to the petitioner on

2 payment of Rs.20,000/- (Rupees twenty thousand only) within three weeks. The balance shall be allowed to pay in ten equal monthly instalments starting from 10.1.2015 onwards. The petitioner shall execute a bond along with two solvent sureties for the balance amount. If the petitioner fails to remit two consecutive instalments, the second respondent is free to take action against the petitioner. The petitioner shall also surrender the RC and the petitioner shall not alienate the vehicle during the period of facility given to him. The first respondent shall give necessary certificates showing that RC has been surrendered by the petitioner. On satisfaction of the entire payment, the RC shall be returned to the petitioner.
Writ petition is disposed of as above.
