Heard learned counsel for the parties and learned A.G.A. for the State.
The present application is filed by the applicants for quashing the charge sheet dated 16.2.2018 including order dated 20.8.2018 passed by Sessions Judge, Kanpur Nagar, and the entire proceedings of S.T.No.284 of 2018 (State vs.Pavneet Gandhi and others) arising out of Case Crime No.9 of 2018, under Sections 498A, 304B, 323 IPC & Section 3/4 D.P.Act P.S. Kohna, District-Kanpur Nagar pending in the court of District and Sessions Judge, Kanpur Nagar.
Learned counsel for the applicants submitted that it is a case under section 306 and not under Section 304B of IPC as suicide video. There is no allegation of dowry in suicide video The deceased has mentioned that she has committed suicide on being harassed and tortured by her father-in-law and mother-in- law. The family of the deceasd has appeared as witnesses and given statement that there was demand of dowry because of which she committed suicide. There is a case under Section 304B which is rightly passed by the court below treating the applicants under Section 304IPC. This application is filed by mother-in-law and father-in-law of deceased so far as husband is concerned.
I have perused the record and the submissions advanced by the learned counsel for the parties and in view of the above, no interference is made out.
The statement made in the video is different and this order is only with regard to the applicants in this case.
Accordingly the application filed under Section 482 is dismissed.
