Learned A.G.A. has accepted notice on behalf of respondent nos. 1 and 2.
Issue notice to respondent no. 3 returnable within next twelve weeks.
It has been contended on behalf of petitioners that after the death of her husband, respondent no. 3 voluntarily left the house and has also taken Xylo car which is reflected from the document filed at page 19 of the paper book. In this background it has been stated that criminal forum has been chosen to exert pressure upon the petitioners, for getting much more share with ulterior motive and entire family has been roped in.
Primafacie arguments advanced requires consideration by this Court.
Consequently, till the next date of listing or till submission of report under Section 173(2)Cr.P.C, petitioners shall not be arrested in case crime no. 1137 of 2010 under Section 498-A, 323, 506,406 IPC & 3/4 D.P. Act Police Station Kotwali District Muzaffarnagar subject to condition that petitioners shall extend all possible cooperation within ongoing investigation.
