M/S Janmejai Singh Thru. Prop. Mr ... vs State Of U.P. Thru. Prin. Secy. ...

High Court Of Judicature at Allahabad|30 August, 2019

JUDGMENT / ORDER

Hon'ble Alok Mathur,J.
Heard Sri Amit Kumar Singh Bhadauria, learned counsel for the petitioner and Sri Sandeep Dixit, learned Senior Advocate assisted by Sri Shree Prakash Singh, learned counsel for the respondent.
Learned counsel for the parties submits that pursuant to the interim order passed by this Court, the petitioner has completed the work. Thus, the writ petition has become infructuous for challenge to the order of termination of the contract.
We find that by virtue of the interim order, the termination remained ineffective and otherwise the petitioner has completed the work. The statement regarding completion of work would however not mean satisfaction rather we keep aforesaid open for the parties. The present writ petition has become infructuous in the light of the statement made by the parties.
Accordingly, it is dismissed as infructuous.
