Petitioners are aggrieved by the encroachment of 70 feet wide road of Scheme No.1, Govind Nagar, Kanpur. It is alleged that under the town planning the said road is 70 feet wide but by encroaching upon it so as to beautify the area or to plant trees etc. it is being reduced to 35 feet.
The matter requires consideration of factual aspect as to the actual width of the road and if it is being reduced upon by the respondents without proper sanction.
The petitioners as such can raise the above grievance before the District Magistrate respondent No.3, who shall examine it at its own hand and after verification of facts pass appropriate order in accordance with law most expeditiously if possible within two months from the date of a copy of this order is produced before him.
Accordingly, the writ petition is disposed of.
