Heard learned counsel for the petitioner and learned Standing Counsel.
Petitioner wants protection to his possession over Plot No.368 area 0.0460 hectare, situate at Village-Latifpur, Pargana- Khairagarh, Tehsil-Koraon, District-Prayagraj.
A reading of the averments made in the writ petition reveals that the petitioner is having a private dispute with respondent Nos. 6 & 7 and his possession is threatened by them. It is also alleged that the State-authorities are helping the said respondents.
In view of the fact that the dispute is in the private domain, the writ petition is not maintainable.
The writ petition is hereby dismissed with liberty to the petitioner to avail the civil remedy available to him in law and it is made clear that the State-authorities have no role to play in such a private dispute, more particularly, when the matter is before the civil court.
