Petition filed under Section 439 Cr.P.C.
2. Petitioner is the accused in Crime No. 150/2014 of Palarivattom Police Station, Ernakulam registered for the offences punishable under Sections 3(2)(c) read with Section 14(a) (b) and (c) of Foreigners Act 1946.
3. The allegation against the petitioner is that she being not a citizen of India, has remained in India without entitlement. It is alleged that she is hailing from Malaysia. At the same time, she has no Visa or Passport with her.
4. Heard learned counsel for the petitioner and learned Public Prosecutor. The learned Public Prosecutor has opposed the petition.
5. The learned Public Prosecutor has pointed out B.A.No.6773 of 2014 -: 2 :-
that if at all she is enlarged on bail, she cannot stay in India and she will have to go in hiding. Matters being so, she is not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
