UTTUR, ADVOCATE FOR R4, R5 IS SERVED) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENTS TO CONSIDER THE REPRESENTATIN DATED 05.05.2017 AT ANNEXURE – B AND ETC., THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R The petitioner has sought for a direction to the respondents to consider the representation dated 05.05.2017 at Annexure –B to the writ petition. The petitioner is a registered company under the provisions of the Companies Act, 1956.
2. It is submitted that the State Government as well as the Central Government have several projects for developing the solar technology and skill training programs among the youth and one such project, ‘SURYA MITHRA’ is hosted by respondent No.6 and the said project is meant for skill seeking development in solar technology in collaboration with the state nodal agencies and the State Government has also similar projects.
3. It is contended that the petitioner company having similar aims and objects has given a representation on 5.5.2017 to the Hon’ble Chief Minister along with the detailed report with a copy to the Additional Chief Secretary, Ministry of Renewable Energy Development Ltd., Government of Karnataka as well as the Director, National Institute of Solar Energy- respondent No.6 but the same has remained unconsidered.
4. Learned counsel for the respondent No.6 has filed a reply wherein it is submitted that the representation submitted by the petitioner shall be considered in accordance with law and appropriate orders shall be passed in an expedite manner.
5. In view of the aforesaid, though the representation is addressed to the Hon’ble Chief Minister, the competent authority-respondent No.6 having submitted before the Court that there is no legal impediment to consider the representation of the petitioner in accordance with law, it is appropriate to direct the respondent No.6 to consider the representation dated 05.05.2017 at Annexure – B in accordance with law and take a decision in an expedite manner, in any event, not later than four weeks from the date of receipt of the certified copy of the order.
The writ petition stands disposed of in terms of the above.
