JUDGMENT / ORDER

Ashok Bhushan, Ag.CJ.
Heard the learned counsel for the petitioner.
2. No notice is being issued to the respondent No.2 in view of the order being passed.
3. Petitioner has filed this Writ Petition alleging police harassment. Petitioner's case is that the first respondent is interfering in the matter and has directed the petitioner to handover the child namely, Akshay to 2nd respondent.
4. Learned Government Pleader, after obtaining instructions, submitted that complaint was received from the 2nd respondent that child was taken away by the petitioner on 7th W.P. (C ) No. 33663 of 2014 - G 2 December, 2014. The police had enquired into the matter and came to know that the issue regarding custody of child is pending before the Family Court, Kollam as O.P. No. 1288/2014 and it is posted to 19-12-2014.
5. In view of the facts as stated above, we do not find that this is a case of police harassment. On a complaint received from respondent No. 2, the petitioner was called. This cannot be termed as police harassment. The matter of custody of the child is already engaging attention of the Family Court, Kollam, who is competent to decide the issue regarding custody of child.
With this observation, we close this Writ Petition.
