Heard learned counsel for the petitioner and learned Standing Counsel for the State- respondents.
The grievance of the petitioner in this writ petition is that proceedings under Section 28 of the UP Revenue Code, 2006 instituted by him in December, 2013, has not been concluded, till date.
Perusal of the order-sheet from 20.09.2018 to 06.06.2019 reveals that on each and every date fixed during this period, the matter has been adjourned on account of lawyers being on strike. In such view of the matter, there appears absolutely no fault on the part of the Court for the case remaining undisposed of.
Under the circumstances, this writ petition is disposed of with the observation that the court below namely, respondent no. 2, Additional District Magistrate (Judicial), Kushinagar may endeavour to dispose of the proceedings under Section 28 of the UP Revenue Code, 2006 expeditiously preferably, within a period of six months from the date of production of a certified copy of this order before him.
This direction will be operative only if the lawyers are not on strike. In case, on the date of disposal, there is yet another strike of the lawyers, this direction need not be implemented.
