The petitioner claims that he is a differently abled person and his disability is about 70%. A copy of the certificate is on the record. He has preferred this writ petition for the following relief:
"(i) issue writ, order or direction in the nature of mandamus directing the respondent no. 2 and 3 to release the property in question from the clutches of respondent 5 to 10, and the possession of property in dispute i.e. Arazi no. 770 Mauja Nagsar Nevaju Rai, Ghazipur, may be handed over to the petitioner forthwith."
The grievance of the petitioner is that his Plot No. 770 in Mauja Nagsar Nevaju Rai, District Ghazipur is his only source of livelihood. The respondent nos. 5 to 10 are causing interference in his possession thus the petitioner is being deprived of his only source of livelihood, hence there is a violation of fundamental enshrined under Article 21 of the Constitution. It is urged that despite several representations and requests the authorities concerned have not taken any action against the private respondents who are powerful persons.
Ordinarily, the Courts do not interfere in the matter of property, however, having regard to the fact that the petitioner is a differently abled person and the authorities have failed to perform its statutory duties, we are of the view that the petitioner is entitled for protection under extraordinary jurisdiction under Article 226 of the Constitution. In addition thereto, the State Government has taken a policy decision to protect the property of a citizen from land mafias and criminals. In this regard a Government order dated 1.5.2017 has been issued. Relevant part of the Government order reads as under:

With the aforesaid directions, the writ petition stands disposed of. No order as to costs.
