Heard Sri Rajesh Kumar, learned counsel for the applicant and Sri G.P. Singh, learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing the order dated 13.05.2019 passed by Additional Sessions Judge/Special Judge, Prevention of Corruption Act, Meerut in C.C. No. 6/2014 under Sections 13/1, (D) 13 (2) of Prevention of Corruption Act, Police station Dakshini Firozabad, District Firozabad.
Learned counsel for the applicant submits that though applicant is facing trial but he has not been supplied with the papers as required under Section 207 Cr.P.C. and when he moved an application for supplying the same, the said application was rejected by the trial court by means of the impugned order which is liable to be set aside by this Court.
Learned AGA on the other hand has opposed the prayer for quashing of the impugned order and has submitted that the case is of the year 2001 and trial is going on. He further submits that the applicant has filed the present application as dilatory tactics to create hurdle in smooth running of the trial and has also concealed a material fact of filing an application under Section 482 Cr.P.C. No.17121 of 2012 'Janardan Lal vs State Of U.P.' which was dismissed by a Division Bench of this Court on 05.01.2016 with liberty granted to the applicant that he may move an application for discharge but it appears that he did not move any such application since 2016 after dismissal of the said application and delay the trial.
After having heard learned counsel for the parties present and perused the impugned order as well as the material brought on record, I am of the view that the impugned order is based upon relevant considerations and supported by cogent reasons and does not suffer from any illegality, infirmity or jurisdictional error requiring any interference by this Court in its inherent power under Section 482 Cr.P.C.
The application lacks merits and is accordingly dismissed.
