JUDGMENT / ORDER

1. This Court has noticed that Mr. Upadhayay, learned Advocate for the respondent - charity commissioner is not attending the hearing of petitions filed by or against the respondent authority and ordinarily almost every time request for adjournment are being made and matters are not attended and Court is unable to proceed in the matter. Despite the fact that several times learned advocate for the respondent authority has been informed that adjournment will not be granted, however, requests for adjournments are being made on his behalf as a result of which the matters are not being proceeded with. Today also request for adjournment is made on his behalf.
2. The respondent - authority, therefore, shall take into consideration the aforesaid aspects and ensure that the proceedings are attended and adjournment are not requested for.
3. Request for adjournment made by the learned counsel for the respondent - authority will not be entertained and the Court will be constrained to pass appropriate orders in absence of learned counsel for the respondent - authority.
4. The Registry is directed to forward this order forthwith to the respondent - authority i.e. respondent no.2 to take necessary action in all matters.
