JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE RAVI R. TRIPATHI) 1.0 Present application is filed by Janakben, wife of Ghanshyamsinh Vaghela through jail seeking Temporary Bail for a period of 21 days on the occasion of marriage of the daughter of her brother. In support of the application, the Marriage Card is enclosed with the application.
2.0 The convict is undergoing life imprisonment for an offences punishable under Sections 302, 120-B and 34 of the Indian Penal Code. She has undergone imprisonment of 08 years and 23 days as on 21st January 2012. She has enjoyed Furlough on four occasions. Last she was out on Furlough from 11th January 2011 to 24th January 2011. She has not enjoyed any Temporary Bail. The Jail Remarks shows that her conduct in jail is satisfactory.
3.0 Rule.
Learned Additional Public Prosecutor Mr. Kodekar waives service of Rule.
4.0 Taking into consideration the contents of the application, the application is allowed. The applicant - convict is ordered to be released on Temporary Bail for a period of 21 days from the date of her release, on her executing a personal bond of Rs.5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authorities. As the marriage is scheduled on 26th February 2012, it will be open for the applicant - convict to choose the date of her release.
4.1 The applicant - convict shall surrender to the jail authorities on expiry of the Temporary Bail period.
4.2 Rule is made absolute to the aforesaid extent.
