2. S. Vanajakshi, W/o late K.R. Rangaiah, Aged about 49 years, Chatrada Beede Pete, Kadri Town, Chickmagalur District – 577 548. ...Respondents (By Sri. Vijaya Kumar Majage, Addl. SPP for R1) This Criminal Petition is filed u/s 482 of Cr.P.C., praying to quash the charge sheet as per Annexure – B filed by the respondent police under Section 420 of IPC in pursuance of Crime No.105/2010 of the respondent police before the Hon’ble Principal Civil Judge and JMFC, Kadur in C.C.No.269/2011.
This Criminal petition coming on for orders, this day, the Court made the following:
O R D E R Learned counsel for the petitioner is absent. Perused the petition.
2. Petitioner has sought to quash C.C.No.269/2011 pending on the file of the Prl. Civil Judge & JMFC, Kadur.
3. When the matter is taken up for hearing, the learned Addl. SPP appearing for respondent No.1 submits that trial is at fag end and the matter is listed before the trial Court for recording evidence of the Investigating Officer.
In view of the above submission, it is not proper to exercise the jurisdiction under Section 482 of Cr.P.C. at this stage.
Hence, petition is dismissed.
