The transfer application has filed seeking transfer of a civil appeal from Firozabad to Agra.
The civil appeal appears to have been filed against an order on an interim injunction application. The suit between the parties is still pending at Firozabad and is not sought to be transferred. The allegations on which transfer of the Civil Appeal is sought would be applicable to the pending suit also. Since transfer of only of the cases is sought, the same shows that this transfer application is not bonafide The transfer application is accordingly dismissed.
