Janak Lali vs Kunwar Bahadur Yadav

High Court Of Judicature at Allahabad|30 August, 2019

JUDGMENT / ORDER

Heard learned counsel for the petitioner and learned counsel for the respondent.
By means of the present writ petition, the petitioner has challenged the impugned order dated 19.09.2014 passed by Principal Judge, Family Court, Gonda in Case No.119/2010.
Learned counsel for the respondent has raised a preliminary objection that against the order dated 19.09.2014 passed under section 125 Cr.P.C., the writ petition is not maintainable under Article 226 of the Constitution of India and the petitioner has got remedy to file a revision under Section 19 (4) of the Family Court Act.
After arguing the matter at some length, learned counsel for the petitioner does not dispute the above said facts.
For the foregoing reasons, the writ petition is dismissed as not maintainable under Article 226 of the Constitution of India on the ground that the petitioner has got remedy to file a revision under Section 19 (4) of the Family Court Act against the order dated 19.09.2014 passed in Case No.119/2010 under Section 125 Cr.P.C.
