Heard Mr. A.S. Pandey, learned counsel for the petitioners and Mr. Ramanand Pandey, learned Additional Chief Standing Counsel for the respondents-State.
The principal prayer made in the writ petition, reads thus:
"(i) Issue a writ, order or direction in the nature of Mandamus directing the respondent Nos. 1,2,3,4 and 5 to provide full and free Cancer- treatment to the patients reaching J.K. Cancer Institute Kanpur under the U.P. Incurable Diseases Free Treatment Rules 2013 framed by Mahamahim Governor of U.P. and notified vide U.P. Government Medical Education Anubhag-2 No. 2181/71-2-2013-18/2012 Lucknow dated 20th June 2013."
After inviting attention of counsel for the petitioners to Part 5 of the U.P. Incurable Diseases Free Treatment Rules, 2013 and having noticed that J.K. Cancer Institute, Kanpur is not covered by these Rules for free Cancer treatment, he prays for withdrawal of the writ petition. He further submits that petitioners may be given liberty to approach the State Government for seeking free treatment to Cancer patients in all Government/Local-self Government Hospitals in the State.
Petition is disposed of as not pressed. It is open to the petitioners to approach the Government, as aforementioned, if they so desire and are advised.
