1. M/s Jan Kalyan Poudhshala through its proprietor Shri Hari Ram has preferred this petition for issuance of a writ in the nature of mandamus directing respondent no. 2 (Divisional Director, Department of Social Forestry, Forest and Wildlife Division, Hardoi) and respondent no.3 (Block Development Officer, Bharkhani, District Hardoi) to purchase tree saplings as per demand raised vide letter dated 12.11.2018 appended with the petition as Annexure-1.

Contention of learned counsel for the petitioner is that a perusal of Annexure-1 would show that in the afforestation drive, the petitioner was asked to get the stock of tree sapling ready to supply. The petitioner has already prepared eight lacs saplings at a heavy expenses, however, the respondents are not purchasing the tree saplings. It has been pleaded that heavy expenses are involved even in maintaining the saplings, on account of vagaries of weather.
3. Learned counsel has pointed out that the petitioner has already made representations vide document Annexures 2 and 3. The respondents are not even taking a decision thereon.
4. Considering the fact that Annexure-1 is addressed to the petitioner and as per Annexure-2 it appears that the petitioner has prepared tree saplings for afforestation drive, we deem it just and proper to dispose of the petition with a direction to respondent no.2 to take a decision on the representations of the petitioner within a period of three weeks of receipt of a certified copy of this order.
5. Disposed of.
