Sri J. Venkateswara Reddy, learned counsel for the appellants, filed memos in both the appeals stating that his clients are desirous of withdrawing these appeals so as to file comprehensive suits seeking appropriate reliefs before the competent civil Court.
2. The common judgment and decree dated 31.07.2001 passed by the learned Principal Junior Civil Judge, Warangal, in O.S.No.53 of 1997 and O.S.No.72 of 1997 were the subject matter of A.S.No.141 of 2001 and A.S.No.136 of 2001 respectively on the file of the learned V Additional District Judge (II-FTC), Warangal, and were confirmed by common judgment and decree dated 26.07.2012. The said common judgment and decree are the subject matter of the present second appeals.
3. As the subject suits were filed for injunction simplicitor, it is now stated that the appellants in these second appeals are to file comprehensive suits for declaratory relief.
4. The second appeals are accordingly dismissed as withdrawn reserving liberty to the appellants to seek appropriate relief in accordance with law before the appropriate forum. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
