Heard learned counsel for the petitioner.
The present petition has been filed for a direction upon the Court concerned to decide Land Acquisition Case No. 38 of 2005 within a stipulated period.
It is the case of the petitioner that his land was acquired under the provisions of Land Acquisition Act, 1894 and ultimately an award was prepared on 30.8.2003, which was not accepted by the petitioner and he has filed an objection before Special Land Acquisition Officer, Saharanpur. Under Sections 30 and 31 of the Land Acquisition Act, reference was prepared in the year 2005 and same was forwarded to District and Sessions Judge, Saharanpur and the same was accepted with Land Acquisition Case No. 38 of 2005. It is submitted that more than 13 years have been passed but till date, no decision has yet been taken. The petitioner has prayed that a suitable direction be issued upon Court below for early disposal of case.
Considering the facts of the case, the petition is disposed of with direction to the court below to decide Land Acquisition Case No. 38 of 2005 expeditiously, preferably within a period of one year from the date of production of certified copy of the order without granting any unnecessary adjournments to either of the parties.
