Heard learned counsel for the parties. The instant application is filed seeking condonation of delay of 44 days caused in preferring the appeal from order. The reason as to why the delay came to be caused have been set-forth in this application, which are supported by the affidavit of the applicant. Having considered the submissions advanced on behalf of both the sides, so also considering the grounds assigned for condonation of delay, this Court is of the opinion that the delay is aptly and sufficiently explained and deserves condonation.
For the foregoing reasons, the application is allowed and the delay of 44 days caused in preferring the appeal from order is condoned. The application stands disposed of accordingly.
