JUDGMENT / ORDER

1. By way of this application, the applicant has prayed for the following reliefs :
"(A) The Hon'ble Court may be pleased to admit and grant this Civil Application.
(B) The Hon'ble Court may be pleased to implead the applicant as party respondent in Company Petition No. 25 of 2011.
(C) The Hon'ble Court may be pleased to pass such other and further orders which may be deemed fit and proper in the interest of justice".
2. Heard Mr. Deepen Desai, learned Counsel for the applicant, Mr. Shalin Mehta with Ms. Vidhi Bhatt for respondent No.1 and Mr. R.S.Shanjanwala, Senior Counsel with Mr. Kanojia for Mr. Maulik Nanavaty for opponent No.2 and Mr. J.S.Yadav for Official Liquidator for opponent No.3.
3. Rule.
Learned Advocates appearing for the respective parties waive notice of Rule.
4. Learned Counsels have submitted that the applicant herein had filed Civil Application No. 65 of 2001 in O.J. Appeal No. 65 of 2001 by opponent No.2 - Company against the order passed by Company Court for being joined as party i.e. for similar reliefs.
5. The Division Bench of this Court (Coram : V.M.Sahai and A.J.Desai, JJ.) by order dated 20.3.2002 was pleased to allow the said application and the present applicant is impleaded as party in the said appeal. Considering the above facts, the present application deserves to be accepted. Prayers prayed in paragraph No.11 are granted. The applicant is impleaded as party respondent in the main Company Petition No. 25 of 2011. The application is allowed accordingly. Rule made absolute to the aforesaid extent.
