JUDGMENT / ORDER

1. The present application is filed through jail by the wife of the convict seeking temporary bail for a period of 45 days for the purpose of getting his son treated for the ailment with which he is suffering. A certificate from Dr.Amin Kureshi is enclosed along with the application, wherein it is mentioned that the son of the convict is suffering from, 'U.T.I. & pain in abdomen'.
2. RULE.
Mr.H.K.Patel, learned Additional Public Prosecutor waives service of Rule on behalf of the respondent-State.
3. Learned APP made available for perusal the jail remarks. The convict has enjoyed temporary bail on 7 different occasions. Last he was released on temporary bail in the month of December 2011 to January 2012 for treatment of his wife. The convict has enjoyed one furlough and every time, he has reported in time. Nothing adverse is noted from the jail remarks.
4. For the contents of the application, the application is allowed. The convict is ordered to be released on temporary bail for a period of 30 (thirty) days from the date of his release, on his executing a personal bond of Rs.5,000/- (Rupees Five Thousand Only) to the satisfaction of the Jail authorities.
5. The convict shall surrender to the Jail authorities on expiry of the temporary bail period.
6. Rule is made absolute.
Registry is directed to communicate this order by fax to the jail authorities. The jail authorities are expected to see that the convict is released by today evening.
