JUDGMENT / ORDER

Rule. Ms. Moxa Thakkar, learned APP waives service of notice of Rule.
Heard Ms. Moxa Thakkar, learned APP for the respondent and perused the record.
Though petitioner is not entitled for any sympathy or favourable order considering the fact that he was released on parole for 12 days in the month of August, 2013. However, at present, considering the fact that between 9th to 31st August, 2013, there were several holidays and it was a religious month of `Ramzan and therefore petitioner could not manage to file an appeal in the Supreme Court. Therefore, as a last chance and with a condition that period of parole shall not be extended further, petitioner be released on parole for seven days on usual terms and conditions, with additional conditions that the petitioner shall mark his presence before Dhoraji police station twice between the period of parole. Petitioner has to select the dates to be released on parole so as to enable him to complete the requirement. Thereby, he shall not claim of benefit or disadvantage of parole or holidays on any ground.
This petition is partly allowed. Rule is made absolute to the aforesaid extent.
