Heard learned counsel for the applicant, learned AGA and perused the record.
By means of this application, the applicant who is involved in case crime no. 55 of 2018, under Section 376-D, 120B, 452, 354, 506 IPC, P.S. Doghat, District- Baghpat is seeking enlargement on bail during the trial.
Submissions made by the counsel that this is a case of gang rape. The accused applicant has assigned the role that he was only watching at the door and the other co-accused persons namely Naseem and Shoeb has committed gang rape upon the poor victim. Though, the accused has assigned only role of watching at the door but he was actively participated in the offence and his complicity and presence over the place of occurrence cannot be ruled out. It is difficult to assume that he would be remained silent spectator of entire incident.
Under the circumstances, I am not inclined to grant indulgence to the accused applicant. Thus the bail application stands rejected.
