This writ petition has been filed to quash the F.I.R. dated 23.12.2018 registered as Case Crime No. 311 of 2018 under Sections 498-A, 304-B I.P.C. and Section 3/4 Dowry Prohibition Act, PS- Simbhawali, District- Hapur.
In the F.I.R. in substance the allegation has been made that Mantasha, daughter of the informant was married to Danish, son of Zamil nine months ago. At the time of marriage the informant had given sufficient dowry but her in-laws were not satisfied with the dowry. They were demanding one motor- cycle and Rs. 1 lac cash as additional dowry. The informant could not be able to satisfy the demand of dowry. Therefore, they cause murder of the Mantasha, the daughter of the informant given her electric shock. In the post mortem report also, the cause of death was found to be electric shock.
F.I.R. discloses the cognizable offence as such it is not liable to be quashed.
However, it is directed that in case the petitioners appear and surrender before the court below and apply for bail, their prayer for bail shall be considered and decided expeditiously according to law and suitable order be passed in it.
With the above directions, this writ petition is disposed of finally.
